Privacy statement

In short

1. Who is responsible

The controller is Clear Agency VOF, a general partnership under Dutch law, Druivenstraat 55, 4816 KB Breda, the Netherlands, Chamber of Commerce (KvK) 42152282, VAT NL869945713B01. The partners are Raul Hansma and Devin van de Laar.

Clear Agency VOF trades as Clear Agency (also “Clear Agency & Management”) and as FERAL Agency (a trade name of Clear Agency VOF; Feral Agency B.V. in formation). This statement covers www.agency-clear.com, www.agencyferal.com, the artist pages under www.agency-clear.com/artists, the academy and the artist portal at portaal.agency-clear.com.

For anything about your personal data, email contact@agency-clear.com or write to the address above. We have not appointed a data protection officer; the partners handle privacy questions themselves.

2. Visiting our websites

www.agency-clear.com, the artist pages and the portal are hosted by Hostinger on servers in the European Union. Like every web server, theirs keeps technical logs (IP address, time, requested page, browser type) to keep the service secure and working. We do not use these logs to follow individual visitors.

On www.agency-clear.com we do not use analytics or advertising cookies, and we do not load anything from Google or other third parties when the page opens: fonts, images and videos come from our own server. Your browser may store a few settings locally (for example your cookie choice on an artist page, see section 5).

agencyferal.com is hosted by Vercel (USA). That site records page views and clicks on its own server together with the page you came from (referrer), without cookies. See also section 3.

3. Booking and contact forms

What. The details you type in the form: name, email address, phone number if you give one, and what your request is about (for example artist, venue or event, city, date and capacity, an indication of the fee you have in mind, the slot and set time; your project and links; your company; your publication and deadline; your message).

Offer sheet. Below the form we link to our offer sheet. That form is hosted by Artistu, the booking software we use as our processor (see section 13); what you enter there reaches us through Artistu. Advancing, travel and guest list for a confirmed show also go through Artistu.

When. Only when you press “Send request”. The form on www.agency-clear.com never sends anything you have typed but not sent.

How. The request goes to our own server, which emails it to bookings@agency-clear.com, or to bookings@agencyferal.com for FERAL artists. The server keeps a copy for 30 days, so that no request gets lost if an email does not arrive, and then deletes it automatically. To stop abuse we count how many requests come from one connection; for that we store only a scrambled (hashed) version of your IP address, which we delete after 24 hours. A hidden field catches automated spam.

Why. To answer your request and, if it leads to a booking or collaboration, to prepare an agreement. The legal basis is taking steps at your request before entering into a contract (Article 6(1)(b) GDPR) and our legitimate interest in answering business enquiries (Article 6(1)(f) GDPR).

How long. Up to 24 months after our last contact. If a booking follows, the agreement and invoices are kept for 7 years because tax law requires it.

agencyferal.com. The form on agencyferal.com is processed by a server function at Vercel and delivered to bookings@agencyferal.com. At the time of writing that form can also pass on details you have typed (intent, name and email) if you leave the page or stay inactive for five minutes without pressing send. We are removing this. If you want such an incomplete entry deleted, email us.

4. Artist pages

The pages under www.agency-clear.com/artists show a bio, photos, riders, music and a timeline of each artist. We count page views and downloads per artist per day. These counts contain no IP address, no cookie and nothing that identifies you; known bots are not counted.

The banner offers “Accept” and “Only necessary” as equal buttons. Choosing “Only necessary” changes nothing else on the page. You can change your choice via “Cookie settings” at the bottom of the artist page. The legal basis for the pixels is your consent (Article 6(1)(a) GDPR and Article 11.7a of the Dutch Telecommunications Act).

For collecting and sending data through the pixel, Meta Platforms Ireland Ltd. and TikTok Technology Ltd. (Ireland) are jointly responsible with us. What they do with the data afterwards is their own responsibility; see their privacy policies. Both may transfer data to the United States.

6. Instagram images of our artists

To show our artists’ most liked posts without loading anything from Instagram, we keep our own copies of a few images from their Instagram accounts (and use those in the timeline). Clicking an image takes you to the post on Instagram. We only do this for artists we represent. If you appear in such an image and would like it removed, email us; we will remove it.

7. The artist portal

portaal.agency-clear.com is where our artists, managers, interns and the FERAL team work together. Access is by invitation only.

What we process

Why and on what basis

To carry out the management and booking agreements with our artists and the work with our team (Article 6(1)(b) GDPR), to keep books and records we are legally required to keep (Article 6(1)(c)) and to keep the portal secure (Article 6(1)(f)).

Who sees what

The owners and general managers see the files, tasks, shows and money of the artists they work with. An artist sees his own file, and so does a second login he has asked for (for example his own manager). Interns do not see the financial figures, Clear Code reports, intake answers or meetings. Observers of FERAL see the FERAL artists only and can change nothing (section 12).

8. Clear Code: how are you doing

In the portal an artist can let us know that things are heavy, with an optional note and a request for a conversation. This is information about someone’s health, a special category of personal data. We store it only with the artist’s explicit consent (Article 9(2)(a) GDPR), given with a tick box each time, and we record when that consent was given.

Answers to the intake question about mental wellbeing are part of the artist’s file. They are visible to his management team and, for FERAL artists, to the FERAL observers (section 12), not to interns.

9. Meetings and minutes

Meetings with artists and within the team usually take place in Google Meet. Fireflies.ai (USA) joins to record and transcribe them. The minutes appear in the portal and in the artist’s Dropbox folder (team minutes in a team folder). The basis is the performance of our agreement with the artist (Article 6(1)(b)) and our legitimate interest in an accurate record (Article 6(1)(f)). If you do not want a meeting recorded, say so at the start; we will then switch Fireflies off.

10. Scouting

We follow the public Instagram figures (number of followers and posts, average likes, posts in the last 30 days) of artists we might want to work with, via the Instagram Graph API of Meta. The team may add dated notes, for example about releases or support from other DJs, and our AI assistant may suggest artists in the same genres. We only use public professional information; we do not read private messages.

We do this on the basis of our legitimate interest in finding new talent (Article 6(1)(f) GDPR). You have the right to object at any time: email contact@agency-clear.com and we will stop immediately and delete your data. If we decide not to proceed, we stop measuring and delete the data 12 months after that decision.

11. Promoters, venues and business contacts

To find bookings we collect business contact details of promoters, venues, festivals and labels from public sources, such as their websites and the bio or link-in-bio of their Instagram account (partly with the help of Apify), and we keep them in our CRM (HubSpot). We use them to contact you about our artists. The basis is our legitimate interest in business development (Article 6(1)(f) GDPR). You can ask us at any time to stop contacting you; we then record that and do not contact you again. For bookings we use Artistu for offers, agreements and advancing, and Exact Online for our accounts.

12. FERAL Agency and observers in the UK

Three people of the FERAL team, based in the United Kingdom, have observer accounts in the portal. They see what a general manager sees of the FERAL artists (files including intake answers, meetings and minutes, agenda, tasks, shows and figures), to help manage them. They can change nothing and do not see Clear Code reports, other artists or the agency’s own figures. They process this data on our behalf and on our instructions. The United Kingdom has an adequacy decision of the European Commission, so the data remains protected at an EU level.

13. Service providers and transfers

We use the service providers below. Where they process data for us, they do so as processors under a data processing agreement, usually their standard terms. We never sell personal data.

Transfers to the United States take place on the basis of the EU-US Data Privacy Framework where the provider is certified, or otherwise the European Commission’s standard contractual clauses. Decisions about bookings, contracts and working together are always made by a person, never by the AI assistant alone.

15. Your rights and complaints

You have the right to access your data, to have it corrected or deleted, to restrict its use, to data portability, and to object to use based on legitimate interest (such as scouting and business contact). Where we rely on consent, you can withdraw it at any time; that does not affect what happened before. Email contact@agency-clear.com. We answer within one month and may ask you to confirm who you are, without asking for a copy of your ID.

If you are not satisfied, you can file a complaint with the Dutch Data Protection Authority, the Autoriteit Persoonsgegevens, or with the authority in your own country.

16. Security

The websites and portal run only over HTTPS. Logging in to the portal with a password always requires two-step verification (or you sign in with your Google account). It has a strict content security policy, blocks repeated failed logins and logs important actions. Form copies are stored outside the public part of the server. Access to data is limited to the people who need it for their work.

We update this statement when our way of working changes. The date at the top shows the latest version.
